1. Platform Nature & Acceptable Use

Rubbyside™ is an online listing platform designed to connect independent buyers and sellers of pre-owned motorcycle gear in India, as well as a social space via The Paddock. By using this platform, you agree to strictly abide by our Acceptable Use Policy, which governs user behavior, content standards, and prohibited items. We are **not** a party to any transactions, payments, shipping arrangements, or deals negotiated between users.

2. Direct Rider Deals

All inquiries and sales coordination are conducted directly between users over third-party channels (specifically WhatsApp). Users are solely responsible for coordinating handoffs, inspections, shipping, and payments. We strongly advise meeting in safe, public locations and thoroughly inspecting gear prior to exchanging funds.

3. Listing Content & Accuracy

When listing gear, you represent that all information (including price, manufacturer, brand, condition, and purchase year) is authentic, accurate, and owned by you. Rubbyside reserves the right to moderate, hide, or permanently delete any listings that contain misleading descriptions, false representations, or spam.

4. Prohibited Gear

Users may only list motorcycle riding gear and protective apparel (helmets, jackets, gloves, boots, luggage, suits, and body armor). You may not list: stolen property, gear without ownership rights, non-motorcycle items, services or digital goods, counterfeit or replica safety equipment, or gear knowingly damaged in a crash without disclosure. Listing prohibited items will result in an immediate and permanent phone number ban.

5. Account Verification

We require verified phone numbers (via OTP authentication) to list gear. You agree that the phone number provided is yours, and that you will not use virtual numbers or VoIP bypasses to circumvent security checks.

6. The Paddock, Flybys, & Social Features

Rubbyside provides social feeds ("The Paddock" and "Flybys") for riders to share photos, videos, and stories. By posting content to these feeds, you agree to our Community Guidelines. You must own the rights to the photos and videos you upload, and you grant Rubbyside the license to display them. You may not post hate speech, harassment, explicit/NSFW content, doxxing, or engage in illegal activities. Rubbyside reserves the right (but not the obligation) to monitor, edit, or delete any posts, videos, or comments, and can ban users at its sole discretion without warning.

7. WhatsApp Notifications

By creating an account and participating in The Paddock or marketplace, you explicitly consent to receiving automated transactional and notification messages (such as comment alerts) via WhatsApp. You acknowledge that these messages are processed by third-party APIs (Meta).

8. Termination

We reserve the right to suspend or terminate access to the platform for any user violating these terms, engaging in harassment, initiating fraudulent offers, or attempting to compromise the security of the website.

9. Intellectual Property

Rubbyside™ is a trademark of Mountain Moto Club. The platform name, logo, and brand identity are the exclusive property of Mountain Moto Club. You may not reproduce, imitate, or use the Rubbyside™ name or logo in any commercial or misleading context without prior written consent.

All platform design, code, and original content is © 2024–2026 Mountain Moto Club. User-submitted listing content remains the property of the respective sellers.

10. Minimum Age Requirement

You must be at least 18 years of age to use this platform. By registering and completing your rider profile, you confirm that you are 18 years of age or older. Minors may not use Rubbyside without verifiable parental or legal guardian consent.

11. Data Protection, GDPR & DPDP Act 2023

We collect and process your verified phone number, profile details, and social data solely with your explicit consent to provide marketplace listing and social communication functions. In accordance with the General Data Protection Regulation (GDPR) and the Digital Personal Data Protection (DPDP) Act 2023, you have the right to request deletion of your account and associated personal data at any time by emailing us at mountainmotoclub@gmail.com.

12. User Content Licence

By posting a listing, description, Paddock photo, or comment, you grant Mountain Moto Club a non-exclusive, worldwide, royalty-free, sublicensable licence to host, display, distribute, and promote your content on the platform and associated social media channels for marketplace discovery and marketing purposes. You retain full copyright ownership of your original content. We respect copyright laws and will comply with valid DMCA or equivalent takedown notices regarding stolen content.

13. Law Enforcement Cooperation

We fully cooperate with law enforcement agencies. We reserve the right to disclose user data (including phone numbers, IP addresses, and comment logs) to legal authorities without the user's consent if we reasonably suspect illegal activities, fraud, or the fencing of stolen goods.

14. Governing Law & Jurisdiction

These Terms of Service shall be governed by, and construed in accordance with, the laws of India. Any disputes, controversies, or legal proceedings arising out of or in connection with the platform shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.

15. Grievance Officer Notice

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, any grievances regarding the platform, content, or data protection can be addressed to our Grievance Officer:
